Terms of service
The whole contract between you and ServPrivacy. Short on purpose: prepaid balance, unmanaged servers, no identity collected, courts respected.
1. Scope and acceptance
These terms govern every service sold at servprivacy.io — virtual private servers, dedicated servers and the prepaid balance that pays for them. Creating an account, topping up or deploying a server means you accept these terms together with the acceptable use policy, the privacy policy and the service level agreement; all four documents form one contract.
We revise these documents by publishing a new version here with an updated revision date. Continued use after a revision is acceptance. We do not send change notices — we hold no address to send them to.
2. The service
ServPrivacy provides unmanaged compute. We operate the datacenter contracts, hardware, network, virtualization layer and DDoS mitigation; you administer everything from the operating system up. Root is yours, and so is everything root breaks.
- Provisioning targets: VPS within 15 min of purchase, dedicated servers within 2–12 h. These are targets, not guarantees — uptime commitments live in the SLA, which also says what happens when a handover is seriously late.
- Plan specifications, regions and prices are published on this site and may change for future orders. A period you have already paid for is never re-priced.
- Included DDoS mitigation (1.5 Tbps upstream) protects the platform first. Under extreme attack we may null-route a targeted address to protect neighbouring customers.
3. Accounts
An account is a handle and a password — nothing else. We verify no identity, so recovery is mechanical: eight one-time recovery codes are issued at registration, and they, not a support ticket, are the way back in. Lose the password and every code and the account is unrecoverable by design; there exists no proof of ownership we would accept.
You are responsible for what your credentials do. Enable two-factor authentication in the panel if the account carries a balance worth protecting.
4. Balance and billing
All services are paid from a prepaid balance. Top-ups are crypto-only, between $30.00 and $5,000.00 per invoice, with bonus credit per the published schedule. There is no card on file, no auto-charge against any external source, and no invoice mailed to a billing address.
- Prices are in USD. Crypto deposits convert at the payment provider's rate when the invoice settles, not when it is created.
- Bonus credit is spendable on any service but is not refundable and not withdrawable.
- A server runs for the period paid and stops at the end of it unless renewed from balance. A stopped server is retained for 7 days, then deleted together with its data.
5. Refunds
Unused paid balance is refundable as crypto within 30 days of the top-up that funded it, minus network fees, to an address you control. Bonus credit is deducted before any refund is computed. Balance already spent on service periods is not refundable, except where the SLA or a failed provisioning says otherwise. Request refunds through the panel or the contact form.
6. Suspension and termination
You may stop using the service at any time; nothing renews behind your back, because nothing can charge you behind your back. We may suspend or terminate in three cases:
- Acceptable-use violations, handled per the AUP's enforcement ladder. Its absolute prohibitions end the contract immediately.
- Non-payment: the server stops at period end and is deleted, with its data, 7 days later.
- Legal compulsion: we comply with verified orders from courts of competent jurisdiction and terminate exactly what the order requires — see the privacy policy for what disclosure can and cannot include.
On termination for cause, remaining bonus credit is forfeited. Refundable paid balance is handled under section 5, unless the funds themselves are evidence in a fraud case.
7. Liability
Beyond the credits defined in the SLA, the service is provided as-is. To the maximum extent applicable law allows, we are not liable for indirect or consequential damages — lost profits, lost opportunities, or lost data you did not back up. Aggregate liability is capped at the amounts you paid us in the three months before the event giving rise to the claim. Where local law sets a higher floor, the legal floor applies.
Unmanaged hosting means backups are your job. The daily encrypted backup addon ($3.50/mo on VPS) exists precisely so this clause never matters to you.
8. Questions
